BATHINDA: On the day a minor dalit schoolgirl from Sangrur district who had committed self-immolation after being stalked by four youths died at PGI, three youths allegedly gang-raped another schoolgirl from a village in Bathinda on Tuesday.


The accused abducted the daughter of a farmhand from outside her school and allegedly gang-raped her in a tubewell room in the fields of one of the accused .


The youths — Badal Singh, Gora Singh and Sandeep Singh, aged between 22 and 24 — dumped the girl after raping her. Medical examination of the rape survivor at Bathinda civil hospital confirmed sexual assault.


The girl, a Class XI student at a government senior secondary school, used to go to school in a van along with other children from her village. "On Tuesday, the accused followed her. When the girl got off the van at the school gate, Badal told her that her mother had taken ill. The girl asked him to wait so that she could inform her teacher, but he insisted that she should accompany him immediately. He took the girl to the car where Gora and Sandep were waiting and whisked her away. They then raped her," said investigating officer Bikkar Singh.


The teenager informed her parents about the incident and they approached the police. "Police got the girl medically examined and rape was established," the officer said.


"A case under sections 376 D (rape by one or more persons), 342 (wrongful confinement), 506 (criminal intimidation) of the IPC and sections 3 and of the Protection of Children From Sexual Offences (POCSO) Act, 2012 was registered against the three accused. The statement of the girl will be recorded before the chief judicial magistrate at Talwandi Sabo on Thursday," he said.

SANGRUR: The 16-year-old dalit girl, who had immolated herself after being harassed by four youths, was cremated on Wednesday after police nabbed the remaining three accused. The victim's family had refused to cremate her earlier, demanding that all the accused youths be arrested.


The victim's body reached her village in Sangrur district around 11.30am and was taken for cremation soon after. However, once at the crematorium, some youths and representatives of several organizations carried the body outside to start a protest on the Lehra-Patran road. They demanded that police arrest all the accused in the case and threatened not to cremate the girl unless it was done.


As her family remained firm on not cremating the body till police took action against the remaining three youths, Sangrur police announced their arrest around2pm. The victim was cremated around an hour later.


"We have arrested the other three accused on the basis of supplementary statement given by the victim's brother. All of them are school students and have been charged under similar sections under which the first accused was arrested," said Lehragaga deputy superintendent of police Bimal Sharma.


The three accused were arrested and charged under sections 306 (abetment to suicide), 354 (assault or criminal force to woman with intent to outrage her modesty), 354D (follows a woman and contacts, or attempts to contact such woman) and 511 of the IPC, and Section 4 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.


Police had arrested one accused in the case on Tuesday, saying the victim had mentioned only his name in her statement to the magistrate. However, the victim's brother had claimed that three other boys had also harassed her and demanded that they too should be arrested. In a video clip recorded by the victim's family a day before the girl died, she had named four youths in her statement.


Police took Sanjeev Mintu, president of Krantikari Pendu Mazdoor Union, the victim's brother and some other protesters to the police station to show them the arrested three youths.


Barring chief parliamentary secretary Dr Navjot Kaur Sidhu, no other senior leader visited the family. Dr Sidhu and former MLA and senior CPI leader Hardev Arshi were present during the cremation.


BJP leader Navjot Kaur, who joined the family in staging a protest, said she would urge the state government to install CCTV cameras in every police station so that there is a visual record of visitors and of police response to their complaint. She added that she would request the government to pay compensation of Rs 10 lakh to the victim's family.


"If the government fails to do so, I will provide financial help of Rs 10 lakh to the family from my MLA fund," she added. If need be, she added, she would hold a protest in front of the office of the Punjab education minister to demand upgradation of the village school so that girls can pursue their studies easily.

Bhagana rape victims to challenge acquittal of accused

The victims of the Bhagana rape case have decided to challenge the verdict of the district court to acquit the four accused in the case in the High Court.

 

Ram Niwas Kush, the complainant's counsel, said they would file an appeal against the acquittal in the Punjab and Haryana High Court. "Three of the four girls were minor at the time of the incident. The medical examination has also confirmed rape. The accused had taken them in a car from the village and they were found at the Bathinda railway station," he said, maintaining he was not satisfied with the decision. —TNS

HC Directs State Government to Set Up Centralised Panel

CHENNAI: The Madras High Court has directed the state government to set up a centralized committee to verify the position of allotment of 'Panjami' lands in different districts to ensure that beneficiaries actually get the land.

A petition was filed by one Arungunam S. Vinayagam seeking a direction to constitute a Commission or a Committee to restore the 'Panjami' lands which are under the control and possession of non-SC/ST people.

 

The First Bench, comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam, before which the plea came up, in its order said "we are of the view that since this issue is cropping again and again in different petitions, it would be just and necessary that the state government constitutes a centralized committee to verify the position of allotment of the above said lands to ensure that the beneficiaries actually get the land."

 

According to the petitioner, he made a representation on July 16 to the government to constitute a committee presided over by someone of Chief Secretary rank and inclusive of officials of National Commission for SC/ST and National Human Rights Commission to identify Panjami lands under the control and possession of non-SC/ST people in Tamil Nadu.


The petitioner had sought restoration of the lands to its original position and to distribute it to the poor Scheduled Caste and Scheduled Tribe people within a stipulated period of time.

 

The First Bench observed that the petitioner seeks to raise a larger issue without really getting specifics of the lands which are earmarked for Scheduled Caste and Scheduled Tribe community and being occupied by persons not belonging to the community.

 

However, as the petitioner states that the government should itself constitute a committee, his representation should be accordingly disposed of within a maximum period of six weeks from the date of receipt of a copy of this order, the bench said.

A day before the state Assembly begins its brief Monsoon Session, the BSPThursday said it will "strongly oppose" the Akhilesh Yadav government's recent decision to amend the Land Reforms Act and other issues affecting the populace.


Addressing the media, Leader of Opposition in the UP Legislative Assembly, Swami Prasad Maurya said the state's law and order situation has "become worse" with the public stuck between "the goons protected by the ruling Samajwadi Party and the goons in khaki".

 

He said the face of police brutality has been exposed in the incidents in Barabanki, Hamirpur and Sitapur, where policemen were accused of atrocities.

 

Maurya also criticised the government's attempt to amend the UP Zamindari Abolition and Land Reforms Act, 1950, saying that the amendment was a "conspiracy to facilitate the mafias to grab Dalits' land". The amendment proposes to simplify the procedure of enabling a land owner (belonging to Scheduled Caste) to sell or transfer his land. The BSP leader said the government wanted to remove the restriction which mandates that Dalits can only sell their land after gaining approval from the district collector.

 

Maurya further slammed the government for "not doing anything" to help the farmers. "They have once again been hit by the drought. Sugarcane farmers are still waiting for their dues to get cleared. All this when the SP leaders do not get tired of calling themselves dhartiputra (son of the soil)," the BSP leader said.

 

Leader of Opposition in the Legislative Council, Naseemuddin Siddiqui said the government was bringing a supplementary budget of Rs 22,000 crore in this Session while the funds allocated in the primary budget have not been utilised even up to 10 per cent by any of its departments.

 

"We want to know on what basis is the government introducing this supplementary budget when the earlier one is still lying unused," he said.

 

Siddiqui also said that ministers like Vijay Bahadur Pal "have no right to be in the ministry" and that Chief Minister Akhilesh Yadav should write to the Governor seeking his removal.

 

Addressing the closing ceremony of a cycle rally in Kannauj, the state secondary education minister had said on Wednesday: "Unko lagta hai ke woh patrakarita ki talwar se hauwa paida kardenge… Woh nahin jaante ki hum Samajwadi hain… agar humein gussa aa gaya, to halla bol denge… auquat yaad aa jayegi. (Some journalists think they can frighten us through their writings. They don't know if Samajwadis get enraged, they will be cut to size)."

The Madras High Court on Thursday ruled that the Scheduled Castecandidates who had migrated from other states cannot demand right of reservation even though they had lived in the union territory of Puducherry for five years.

 

"Residents, as indicated in the Presidential Order dated March 5,1964, would only mean such residents who were available on that date and not thereafter Merely because a person resides for various reasons in the union territory of Puducherry, cannot be given the status and he cannot be allowed to be brought under the umbrella of the Presidential Order," Justice M.M. Sundresh said He was dismissing a batch of petitions filed by Dalits who had migrated from Tamil Nadu and living in Puduchery for five years.

 

The petitioners sought inclusion in the Scheduled Caste category enabling to get admission in professional courses in colleges and other courses of higher education.

 

"Merely because a Scheduled Caste person migrated to Puducherry from another state, resided there for five years and obtained a certificate of residence as well, he cannot be treated as a resident for the purpose of admission in professional courses meant for natives of the union territory," the judge said.

 

"Similarly, such a person does not lose his right of reservation in the state in which he is a permanent resident and from where he had migrated to Puducherry." Clarifying that the residential certificate cannot be used for the purpose of including such a person in the SC category to get the benefit of reservation in the union territory, the Judge said a certificate of residence given after completion of five years cannot be used to define a resident as mentioned in the Presidential Order.

 

"A mere issuance of certificate of residence issued to a migrant would not give a vested right to be treated under the reservation category for the purpose of education." "Such a certificate has been given to every other person who comes to the union territory of Puducherry and resides therein for five years. It is given merely based upon the period of stay, and therefore, has nothing to do with the status."


"The purpose of reservation is meant to overcome backwardness and other disadvantages of a caste in a particular caste, and thus it does not have any relevance to the period of stay," the judge said.

After the launch of the two collectors' editions on Dalit icon B.R. Ambedkar by RSS mouthpieces Organiser and Panchjanya in April this year, the RSS chief launched four books in Hindi on Ambedkar on Thursday

 

The move comes just months ahead of the Bihar Assembly polls which are expected to become another rallying point with the Dalit votebank. 

 

The four books are based on the "encouraging public speeches and statements" made by Ambedkar. 


The volumes have been edited by educationist Dr Narendra Jadhav. 

Responding to accusations of newly-found love for Dalits, Mohan Bhagwat said, "Why are some sections having problems if the followers of Dr KB Hedgewar and Dr BR Ambedkar come together on the same platform to solve the evils of India when we have the same vision of Indian society." 

 

"We have not started talking about Dalits recently. In the training session in 1939 held in Nagpur, Dr Ambedkar had attended the session in the presence of Dr Hedgewar. 

 

"Dr Hedgewar asked Dr Ambedkar to join the session for communal dining and the latter was so impressed with the practice that he said that Sangh was doing the same things that he wanted to do. Also, instead of Dr Hedgewar's speech, Dr Ambedkar was made to deliver the speech," said Bhagwat. 

 

"Many of my Dalit and journalist friends take potshots at me and ask when I am joining the BJP. I want to say that RSS is s very big organisation and if it comes close to the thought of Babasaheb, what is the harm," said Jadhav.

COIMBATORE: Members of the Vivasayigal Sangam (non-political) staged a protest near South tahsildar office demanding the officials of Horticulture Department to distribute the subsidies and put an end to the irregularities in the department.

 

"Our members had installed drip irrigation system for subsidy rate through contractors three years ago. Department officials assured to distribute the subsidy amount once the government released funds and took Rs  75,000 from small and `1 lakh from large-scale farmers. Though three years have passed, there are no signs of the subsidy reaching us," said Sangam president Kandhasamy.

 

He said that hundreds of farmers across the 10 blocks in the district borrowed money and pledged their jewellery for installing the drip irrigation system.

 

They also claimed that vegetables produced in Tamil Nadu do not contain high pesticides as claimed by Kerala. "Vegetables sent to Kerala are also consumed in Tamil Nadu. The same vegetables are sent to Bengaluru. This is a false propaganda to promote consumption of organic vegetables," Kandhasamy added.

 

They urged the city police to use the SC/ST (Prevention of Atrocities) Act effectively as Kuniyamuthur police denied to register First Information Report when a Dalit farmer lodged a complaint when his land was grabbed by real estate promoters.      

 

They demanded the district administration to take stringent action against the encroachers.


"Even though we have sent repeated petitions to Public works department to clear encroachments near water bodies, no action has been taken. District collector Archana Patnaik should look into this and revive ground water," said Kandhasamy.
